Utah Proposes Reduced Benefits for Positive Marijuana Tests

Back to Regulatory Recap

Utah House Bill 281 was introduced, which would create a rebuttal presumption regarding cannabis use that would reduce workers’ comp awards if an injured worker tested positive for intoxication from THC or a THC analog, with a THC blood level in excess of 20 nanogram/ml.

Furthermore, the bill notes that when testing for marijuana use, a blood test shall be used. If enacted, this bill would go into effect May 6, 2026.
