Texas Proposes Rule Change for Death Investigator Claims

The Texas Division of Workers’ Compensation (DWC) is accepting public input on proposed amendments implementing Labor Code §504.057 (House Bill 1306), which establishes expedited medical benefits and dispute resolution for death investigation professionals injured on the job.

The proposed rules would require the DWC and independent review organizations to be notified so contested cases and appeals receive priority handling. This would change how claims for death investigation professionals are processed, disputed, and documented. They formalize insurer compliance and may require updates to administrative workflows.

The proposed rules will be published in the October 24, 2025, issue of the Texas Register and are available on the DWC website. Comments are due by 5:00 PM CST on November 24, 2025, via mail or email to RuleComments@tdi.texas.gov.
