Two bills that would enable psilocybin therapy have advanced through the legislative cycle and could soon see approval.
Colorado House Bill 1063 would make a prescription medication that contains crystalline polymorph psilocybin legal to prescribe, dispense, possess, use, and market in Colorado upon the approval of such a drug by the FDA, with the aim of helping treat treatment-resistant depression.
This bill recently passed the Senate with a 25-9 vote, after passing the House with a 46-16-2 vote. The bill currently sits with the Governor, but if vetoed, the bill has the necessary two-thirds majority to override a veto.
New Mexico Senate Bill 219 would allow for the use of psilocybin for the treatment of qualified medical conditions. The bill recently passed the House of Representatives with a 56-8 vote, after having passed the Senate with a 33-4 vote. If the Governor were to veto the bill, the legislative chambers have the two-thirds majority necessary to override a veto.
