Oklahoma Issues Bulletin on Ethical AI Use in Insurance

The Oklahoma Insurance Department issued Bulletin No. 2024-11, on the ethical use of AI in insurance.

The bulletin reminds carriers that AI-supported decisions must comply with all applicable laws and regulations and must not be inaccurate, arbitrary, capricious, or discriminatory. Insurers in Oklahoma are required to establish and maintain a written program for the responsible use of AI in regulated insurance practices. This program should mitigate risks of adverse outcomes, operate independently of enterprise risk management systems, and include processes for using third-party data or AI systems developed by external vendors.

While the bulletin outlines ways carriers can demonstrate compliance with state laws, it does not mandate specific practices or documentation. Instead, it aims to clarify the Department's expectations for AI governance and the information insurers should be prepared to provide upon request.
