On September 25th, the Ohio Bureau of Workers' Compensation (BWC) resubmitted outpatient medication rules for self-insured employers to the state’s Common Sense Initiative (CSI), after withdrawing the original proposal on September 3rd due to a technical error.
CSI gathers stakeholder input to ensure proposed regulations are fair, clear, and easy to follow before formal rulemaking begins.
BWC’s resubmitted rules match the original proposal, which includes:
- Time-based dispensing fees for compound medications
- A lower reimbursement cap for non-sterile compounds, from $400 to $100
Healthesystems, a supporter of the original proposal, recommended a 90-day implementation period for the dispensing fee changes. With the resubmission, the rules will now take effect on February 1, 2026, giving stakeholders additional time to prepare.
CSI is accepting public comments through October 9th. After that, BWC will file the rules for formal rulemaking, which includes an additional public hearing.
