The Ohio Bureau of Workers’ Compensation (BWC) proposed rules that would expand coverage for prosthetic devices and artificial appliances.
Under the proposal, the BWC or self-insured employers would cover the purchase, repair, or replacement of these devices through the BWC’s surplus fund if the need stems from an allowed injury or occupational disease. There is no time limit, but coverage does not reopen the claim or extend the statute of limitations.
The updates are now open for public comment through January 14th, through the Common Sense Initiative (CSI) and stem from implementation requirements under House Bill 81. Although prosthetic costs will be covered through the BWC’s surplus fund, the proposed rules introduce administrative provisions not outlined in House Bill 81.
