New York Senate Bill 3008 was recently adopted and includes extensive annual transparency reporting requirements on prescription drug rebates for Pharmacy Benefit Managers (PBMs).
While the original version of the bill applied broadly to all licensed PBMs in the state, it was amended prior to adoption to exclude workers’ compensation PBMs from these reporting provisions. This amendment aligns with ongoing advocacy by the Healthesystems Advocacy and Compliance team, both directly and through AAPAN, to educate the Department of Financial Services on the unique role of workers’ comp PBMs.
The resulting exemption helps reduce unnecessary administrative burden and reflects a growing recognition within the state that workers’ comp PBMs operate differently from traditional healthcare PBMs.
