New Jersey Proposes Comp Exclusion for Intoxication

New Jersey Senate Bill 1555 was introduced, which would amend workers’ comp law to establish that if an employee is intoxicated at the time of an injury or death, it is presumed that the intoxication caused the incident, thereby barring the employee from receiving workers' compensation benefits.

The bill does state, however, that the employer must prove that intoxication caused the injury.

Additionally, the bill states that benefits would not be awarded in cases of intentional self-inflicted injuries and situations where the employee’s failure to use provided PPE contributed to injury or death.
