Nevada Senate Bill 317 was introduced, proposing an expansion to the list of treating providers under workers' comp.
Currently, the Division of Industrial Relations (DIR) and insurers maintain lists of physicians and chiropractors. The bill would add more specialties and give the DIR authority to set rules for managing these lists. Insurers would be required to maintain a panel with at least 12 providers per medical specialty. If the DIR's list contains fewer than 12 providers of a certain type, insurers would be required to include all of them.
Insurers must provide injured workers with a list of specialists within 14 days of a referral. Employees must choose healthcare providers based on the terms of any managed care agreement in place. Workers can select providers from the DIR list if no managed care contract exists. Workers may request a provider change within 90 days; insurers have 10 days to respond, or the change is automatically approved. If the worker does not make a selection, the insurer or managed care organization may choose on their behalf.
Additionally, insurers must update their provider lists annually by October 1st and any removed providers must be replaced within 60 days.
