Delaware Senate Bill 164 was introduced, proposing a one-time 3% increase in aggregate workers’ comp medical expenses to correct reimbursements for medical services coded as evaluation and management (E&M).
The adjustment is intended to address underpayment for E&M codes, which currently fall below the reimbursement levels set by the Centers for Medicare & Medicaid Services. Supporters of the bill argue that the change is essential to address a shortage of physicians willing to accept and treat workers’ comp patients in Delaware.
