California Governor Gavin Newsome recently signed two bills into law impacting the use of artificial intelligence in workers’ comp.
Senate Bill 1120 requires physician oversight for utilization review (UR) decisions that involve a health plan’s AI tools or algorithms. Providers must have final approval of UR decisions when AI is used. This law goes into effect January 1, 2025.
Assembly Bill 3030 requires hospitals, clinics, physicians, and other providers that use AI to generate patient communications to include a disclaimer such communications were generated by AI. This rule will be required if the communication involves patient clinical information and is not reviewed by the medical professional. This law goes into effect January 1, 2025.
