Arizona Senate Bill 1404 was introduced, which could amend workers’ comp laws to broaden injured workers’ ability to make certain care decisions.

If passed, the bill would allow injured workers to select their medical provider, pharmacy, and certain ancillary services, such as lab testing, imaging, and durable medical equipment (DME). However, existing rules that allow employers or carriers to direct care under A.R.S. § 23 1070 would remain unchanged.

Additionally, the bill clarifies that initial compensation payments must be made no later than the 21st day after the Industrial Commission notifies the carrier of a filed claim.

Lawmakers also recently introduced House Bill 2813, a bill moving in the opposite direction, which would allow employers and insurers to require injured workers to use contracted pharmacy networks — an option not currently permitted under Arizona law.
