New York Assembly Bill 11714 was introduced, which proposes implementing a higher percentage of interest and other civil penalties on certain employers or their workers’ comp carriers for non-payment of bills for medical care or supplies.
According to the bill, if the Workers’ Compensation Board rules that an employer or their workers’ comp carrier must pay a disputed medical, the bill must be paid within 15 days. If not paid, starting on the 16th day, a 3% monthly interest rate will take effect until the bill is paid in full.
Additionally, the bill would allow medical care providers or supplies to file claims with the Board if they believe an employer or their carrier has a pattern of non-payment. If the board rules in favor of the provider or supplier, an award interest rate of 3-5% would be implemented, based on severity, duration, and frequency of the non-payment. In cases involving egregious or repeated violations, a 25% interest rate may be applied.
The bill currently defines a pattern or practice of violations as three or more violations within 12 months, or repeated systematic failure to pay, including late payments and late denial notices.
If enacted, the bill would go into effect immediately.
