The New York Workers' Compensation Board (WCB) issued a revised proposal for updates to its medical fee schedules.
Following public comments on its January 2026 proposal, the Board issued a Notice of Revised Rule Making for updates to its Medical, Acupuncture, Physical Therapy/Occupational Therapy, Behavioral Health, Podiatry, and Chiropractic fee schedules.
Notable revisions to the proposal include:
- Correcting CPT code 95999 from "BR" back to 0 RVUs, which the Board identified as a typographical error
- Adding clarifying language throughout the fee schedules regarding applicable provider types
- Revising deposition-related provisions to reference existing regulations governing deposition fees and procedures
- Reverting proposed changes to the Behavioral Health Fee Schedule and maintaining the current fee schedule structure and 2018 CPT code set
- Updating effective-date references pending final adoption
The revised proposal will be published in September 2, 2026 edition of the State Register. Public comments will be accepted for 45 days following publication and may be submitted to regulations@wcb.ny.gov.
