Florida Sets Hearing for Physician Dispensing Rules

The Florida Division of Workers’ Compensation (DWC) scheduled a public hearing on July 15th to discuss proposed rule changes that would remove billing and reimbursement language for physician-dispensed medications from medical billing and bill review rules.

The proposed changes align DWC’s rules with the First District Court of Appeal’s February 2026 decision in Publix Super Markets, Inc. v. Department of Financial Services, which held that an injured worker’s right to choose a pharmacy or pharmacist does not extend to physician dispensing.

Draft rule language is available for review, and stakeholders may attend the hearing virtually.

The notice directs interested parties to contact Charlene Miller, Bureau Chief, Division of Workers’ Compensation, with questions.

This public hearing provides a formal opportunity for stakeholder input before potential adoption and signals continued progress in DWC’s implementation of the court’s decision as payers continue to evaluate or implement aligned approaches.
