Governor Gavin Newsom signed California Senate Bill 574 into law, establishing requirements governing the use of generative artificial intelligence (AI) by attorneys and arbitrators, modifying oversight requirements for certain alternative dispute resolution (ADR) providers.
According to the bill, attorneys may not delegate the practice of law to generative AI and must protect confidential information, verify AI-generated content and citations, correct inaccuracies, and disclose AI use in court filings. Additionally, arbitrators may not delegate decision-making to generative AI or rely on AI-generated information outside the record without disclosure to the parties
In terms of oversight, the State Bar must establish complaint procedures and oversight requirements for certified ADR providers, with protections for confidential complaint proceedings, and the Judicial Council must review judicial administration standards to address developments in generative AI.
The law is expected to take effect January 1, 2027.
