New York Governor Kathy Hochul signed Senate Bill 6635 and Assembly Bill 5745 – two identical bills – that grants all workers in New York the right to file a claim for mental injuries premised upon extraordinary work-related stress incurred on the job.
This new law gives all workers the same access to mental injury presumptions that were granted to first responders in 2017. Additionally, the State Workers’ Compensation Board cannot deny claims solely because the stress is considered typical for the job environment.
This law goes into effect January 1, 2025.
