Texas Seeks Input on Telemedicine Expansion for MMI Certifications

The Texas Department of Insurance, Division of Workers’ Compensation (DWC) proposed amendments to expand the use of telemedicine services for certifying Maximum Medical Improvement (MMI).

These proposed changes are designed to improve access and efficiency for injured workers with minor injuries requiring no further treatment.

Proposed amendments include:

  • Expanding "telemedicine services" to include MMI certifications under 28 TAC §§130.1 and 130.2
  • Providing clear billing guidelines for MMI evaluations by treating doctors, as outlined in 28 TAC §134.250
  • Confirming that impairment rating (IR) examinations are not eligible for telemedicine

Stakeholders have an opportunity to share insights and feedback by submitting comments to RuleComments@tdi.texas.gov no later than 5:00 p.m. CST on January 13, 2025.
