Minnesota Senate File 4612, a nearly 300-page bill that updates supplemental appropriations for the Omnibus Health and Human Services, currently features provisions that would establish a legal, regulated framework for the therapeutic use of psilocybin.

Currently, the program fall under the Office of Cannabis Management and would apply to individuals 21 years of age or older with a registered facilitator, who have been diagnosed with a qualifying medical condition and meet the other requirements for enrollment.

Qualifying medical conditions are defined as “a medical condition designated by the office for which psilocybin shows evidence for an appropriate therapeutic use, including but not limited to posttraumatic stress disorder, depression, substance use disorders, anxiety, and chronic pain.”

An initial program structure would establish that:

• Between 20 to 50 registered facilitators who are currently licensed to administer psychedelics would be required to receive additional training
• At least three different testing facilities will be established
• No more than 1,000 patients with qualifying conditions could register and receive treatment during the first year
• The program would run for three years after the program launches
• The program would be evaluated at the end of the three-year period, with a report to the legislature to determine next steps

Introduced in March, the bill has been reviewed and amended multiple times over the last two months in both chambers, indicating strong interest in reaching a compromised version to pass. However, as various parts of the bill continue to change, it remains uncertain if the psychedelics portion will remain as the bill progresses.
